When you’re in the process of purchasing commercial property in Minnesota, you’ll eventually be given some documents that make up your title commitment. Essentially, a title commitment is a contract issued by a title company that explains what conditions need to be met in order for them to issue a title insurance policy for the property. Below, we take a closer look at this document and why it matters for you as a commercial property buyer.

A title commitment can seem like another run-of-the-mill legal document that you need to acknowledge and sign prior to closing, but it’s imperative that you truly understand this document so that you don’t expose yourself to unnecessary risk. Although each title commitment is a little different, they typically have three main components:

  • Policy Holder And Coverage Basics - The first part of the title commitment will explain who is being insured by the policy and the amount of coverage the policy offers in the event you need to make a claim.

  • Claim Necessities - The title commitment will also cover the claims process and what factors need to be present in order for an insured individual to make a claim on their title insurance policy.

  • Exclusions - A title commitment will also explain what broad or specific issues will be excluded from coverage. In many cases, the policy will also explain what actions you must take in order to have certain exclusions dropped from the commitment (for example, ordering a land survey can remove some standard exclusions that exist on a basic title insurance policy).

It’s important that you and your title services team review these documents to ensure everything appears correct and all parties are on the same page. If you have concerns about exceptions or coverage amounts, now is the time to sort it out. Amending a policy after taking ownership may lead to additional costs, so handling any title commitment concerns prior to closing can save you money.

Reviewing your title commitment and handling any necessary actions to secure title insurance coverage is one of the best ways to protect your financial interests when purchasing commercial property in Minnesota. It can be easy to overlook, and that can leave you vulnerable should you ever need to make a claim, so connect with a title services team that can walk you through the title commitment and make any necessary changes. Every property is different, so a title commitment always deserves individual attention.

If reviewing or understanding a title commitment seems anxiety-inducing to you, work with a team of professionals who understand the industry and can walk you through the process with ease.
